자본주의 체제가 우리의 적이다!
Our enemy is Capitalism!
이주노동자는, 한국에서 가장 착취받고 있는 노동자이다. 이주노동자들의 처지는 한국인 비정규직 노동자보다 더욱 열악하다. 최소한의 생활비에도 턱없이 모자란 저임금에, 살인적인 장시간노동에 시달린다. 일하다가 다치거나 아파도 제대로 치료받을 수 없다. 의료보험이나 고용보험같은 사회보장제도는 꿈도 꾸지 못한다. 퇴직금도 없고, 임금을 제 때 주지 않거나 떼먹히는 경우도 많다. 언제 사장의 말 한 마디에 해고당할지 모른다. 그 뿐 아니다. 미등록 이주노동자에게는 단속추방이라는 공포가 기다리고 있다. 가스총과 그물총을 이용한 인간사냥이 한국 정부에 의해 자행되고 있다. 한국 정부는 이주노동조합의 안와르 위원장 역시 연행해 갔다.
Now, migrant workers(MW) are exploited most from Korea. Ultra low wages, too long working-hours. Even a MW has been wounded in work, he/she can't be healed. MW have no social security like medical insurance or workmen’s accident compensation insurance. And no retiring allowance, what is worse, payment is delayed many times! Capitalists are firing MW at any time. Korean government is going on Crack down with brutality. Anwar, the MTU leader, was arrested by Korean Government.
대체 무엇이 이주노동자를 이런 현실로 내모는 것인가? 그것은 이 자본주의 체제 자체다! 생산의 주역은 노동자이다. 노동자가 일하지 않으면 공장은 돌아가지 않는다. 그렇게 되면 당연히 자본가도 돈을 벌 수 없다. 그렇지만 자본가들은 일하지 않으면서도 그가 공장과 기계를 가지고 있다는 이유로 막대한 이윤을 챙긴다. 그리고 노동자들에게는 되도록 적은 임금과 긴 노동시간을 강요한다. 그럴수록 자본가의 이윤은 더욱 늘어나기 때문이다. 한국에서 비정규직 노동자들이 수백만 명에 달하는 이유는 무엇인가? 필요할 때 쉽게 해고하고, 저임금에 부려먹기 위해서다. 자본가들은 비정규직을 만들어 더욱 많은 이윤을 추구한다. 또한, 정규직과 비정규직 노동자의 갈등을 조장하여 노동자의 단결을 깨뜨린다.
MW are suffering for the capitalism. The capialism is killing the MW. In capitalism, workers are the core of production. If workers go on strike, the factory stops. If that happens, capitalists have no profit. They don't work. They don't produce. But they earn great profits. On the other hand, workers are poor and hungry though they work hard. Capitalists force workers to work more and more, and take the lower wages. Then, capitalists take more profits. Millions of Korean workers are changed to unformality workers.(비정규직) Why? For easy dismiss! For lower wages! For more profits! And capitalists make an effort to destroy the unity of workers.
산업연수생제, 고용허가제가 만들어진 것도 같은 이유다. 이 두 가지 제도는 이주노동자를 착취하기 위해 만들어졌다. 산업연수생제는 사실상 교육을 가장한 노동착취제도이다. 고용허가제 역시 마찬가지다. 고용허가제는 미등록 이주노동자 문제를 해결하지 못하고 있다. 그것은 현실이 말해주고 있다. 고용허가제는 사업장 이동의 자유가 없다. 이는 곧 이주노동자에게 기본적인 노동권을 보장하지 않는다는 의미다. 자본주의 사회에서 정부는 언제나 자본가들의 이해에 충실히 따른다. 고용허가제는 이주노동자를 착취하고 철저하게 통제하기 위해 만들어진 제도이다. 자본가들과 한국 정부는 이주노동자에게 노예처럼 일만 할 것을 강요한다. 노동자로서의 권리는 결코 보장해 줄 생각이 없다. 따라서 당연하게도 이주노조는 불법이 되었고 위원장은 연행되었다.
Capitalists made the trainee system and the EPS to exploit MW. The trainee system is not education. That is just slavery system. EPS is same. EPS does not guarantee the freedom to choose MW's work places. EPS doesn't guarantees the basic labor rights to MW. In capitalism, the government is under control of capital. They made EPS for just exploitation! EPS started 1 year ago, but unregistered workers go on increase. They say "We guarantee the basic labor rights to MW! And 'illegal' workers are decreased!" but that is bold-faced lie. Do we have basic labor rights? No. They say that MTU is illegal. So they arrested the leader of MTU.
이러한 사실로부터 우리는 투쟁의 궁극적인 목표를 분명하게 해야 한다. 임금을 올리고 노동시간을 줄이는 것이 전부는 아니다. 자본가들은 자신의 이윤을 위해 언제나 노동자들을 공격해 온다. 따라서 노동자들은 자본주의 체제 자체에 맞서야 한다. 자본가들을 몰아내고 생산의 주역인 노동자가 사회의 주인이 되어야 한다. 이를 위해 이주노동자건, 한국인 노동자건 노동자의 이름으로 하나가 되어 투쟁해야 한다. 그럴 때만 노동자는 해방될 수 있다. 이것이 노동자들이 투쟁하는 궁극적 목표가 되어야 함을 기억하자.
Standing on the reality of MW in capitalism, we must set the ultimate goal of our struggle. A wage increase and the reduction of working hours is imprtant. But, that is not all! In capitalism, capitalist always attack workers. So all the workers must fight for revolution. Workers must declaim like this. "We made this world by working. We don't need capitalists who don't work!" For this, migrant workers, Korean workers, and workers of all the countries on the earth must UNITE and fight! If workers unite, workers can get liberation for the capital. This is the ultimate goal of MW's struggle.
이주노동자에 대한 자본가들의 모든 통제를 박살내야 한다!
We must smash the capital's regulation system on the migrant workers!
이주노동자들에게는 기본적인 노동권이 없다. 이주노동자에겐 사업장 이동의 자유도, 노조를 결성할 자유도, 파업할 수 있는 자유도 없다. 고용허가제는 노동자라면 당연히 적용받아야 할 노동3권을 이주노동자에게 부여하지 않는다. 고용허가제는 사업장 이동의 자유가 없다. 고용허가제는 자본가들에게 외국인 고용을 허가하는 제도이다. 고용허가제에서 노동자들은 ‘노동자’로 취급받지 않는다. 철저히 하나의 ‘수단’으로-인력으로 취급받는다. 또 고용허가제는 3년의 기간을 제한하고 있다. 1년을 더 늘릴 수 있지만 그것은 철저하게 자본가들의 판단에 따른다. 이 때문에 이주노동자들은 노예노동을 벗어나지 못하고 있다. 이런 열악한 현실 때문에 미등록 이주노동자들은 더욱 늘어나고 있다. 미등록 이주노동자들은 단속추방의 위험에 떨면서 미등록이라는 이유로 자본가들에게 더욱 억압받는다.
MW has no basic labor rights. We have no freedom to choose work places, no fredom to organize labor union, no freedom to strike. EPS does not guaratee basic labor rights - the right to organize, the right to bargain collectively, the right to collective action. EPS permits to capitalist for employment of MW. Under EPS, MW are treated as just instrument to produce profits not human. EPS says MW can stay in Korea for only 3 years. But that is possible when migrant worker obey capitalist. So MW can't escape from the labor like slavery. This bad reality makes more unregistered MW. They are afraid of crack down, and capitalists exploit and threaten them by reason of their illegal condition.
따라서 이주노동자의 해방을 위해 우리는 무엇을 요구하며 싸워야 하는가? 산업연수생이든, E-9비자를 가진 노동자든, 미등록이든 한국의 모든 이주노동자들은 무엇을 위해 싸워야 하는가? 이주노동자들은 자본에 의한 어떠한 통제와 제한도 거부해야 한다. 국가의 통제 제도는 오직 자본가들을 위한 것이다. 이주노동자는 이주노동자를 얽매는 모든 굴레를 박살내는 투쟁을 해야 한다. 노예제도인 고용허가제는 폐지시켜야 한다. 대신에 이주노동자는 어떤 제한도 없는 완전한 사업장 이동의 자유를 쟁취해야 한다. 또, 체류기간 역시 이주노동자 자신이 스스로 선택해야 한다. 국가가 체류기간을 제한하는 한 미등록은 발생할 수밖에 없으며 단속추방은 계속될 것이다. 그리고 이주노동자는 한국인 노동자와 동일한 노동3권을 쟁취해야 한다. 단결권과 교섭권, 파업권을 투쟁으로 쟁취해야 한다. 이러한 것들이 이주노동자 투쟁의 구체적인 목표가 되어야 한다. 이 중 하나라도 쟁취하지 못한다면 이주노동자들의 노예와 같은 현실은 크게 달라지지 않는다.
So, all the migrant workers in Korea must fight to smash all the regulation and restriction to MW by capitalists. Korean national system is in the interests of only capitalists. Comrades, Let's fight! Let's fight for ABOLISH EPS! Let's fight for WHOLE FREEDOM TO CHOOSE WORK PLACES without any limits! Let's fight for WHOLE FREEDOM TO STAY! Only migrant worker can choose the length of stay by himself/herself. If Korean government limits the length of MW's stay, the unregistered MW will be increase. And let's fight for THE BASIC LABOR RIGHTS that equals to Korean workers! Let's achieve rights to organize, bagain, and strike BY STRUGGLE AND UNITY! These are must become the concrete goal of struggle in present condition. These goals become the basis of the liberation of migrant workers. If we want change the reality, we must do like that.
민주노동당 노동허가제 법안에 문제 있다
Serious problems on Work Permit System bill that KDLP made out
현재 민주노동당이 노동허가제 법안을 마련하였다. 이주노동자들은 노동조합으로 뭉쳐 투쟁해 오면서 항상 <노동비자 쟁취>를 핵심적인 요구로 제시해 왔다. 따라서 많은 이주노동자들이 민주노동당의 노동허가제 법안(이하 입법안)에 기대를 걸고 있다. 그런데 우리는 이 법안의 내용에 대해서 자세하게 검토해 보아야 한다. 이 법안이 이주노동자들의 현실을 개선하고 우리의 투쟁을 진전시키는 데 올바른 것인지 따져 보아야 한다.
Recently, KDLP made out Work Permit System bill. MW have fought for demand working visa. MW's main slogan is working visa. So, many migrant workers are counting on KDLP's WPS bill. By the way, we must examine the details of the bill. Will the bill help our struggle for liberation? Instead, Will the bill makes another limits to our struggle? Let's think about it.
입법안은 근로기준법을 비롯해, 한국인 노동자에게 적용되는 모든 노동법과 사회보장법을 이주노동자에게도 동일하게 적용해야 한다고 말한다. 즉, 이주노동자에게도 노동기본권을 보장한다는 의미이다. 이것은 올바르다. 그런데 법안의 다른 내용들을 보도록 하자. 입법안에 따르면, 이주노동자는 특정 업종에서만 일할 수 있는 노동허가를 얻을 수 있다. 그리고 이주노동자가 직장을 옮기려 할 때에는 같은 업종의 국가에 등록된 사업장으로만 옮길 수 있다. 업종을 변경하고자 한다면 1년 이상 일한 노동자에게만 기회가 주어진다. 그리고 만약 이주노동자가 이러한 규정들을 위반한다면 500만원 이하의 벌금에 처해진다. 이것이 과연 “완전한” 사업장 이동의 자유라고 말할 수 있는가? 결코 그렇지 않다! 이주노동자에게 사업장 이동의 자유란 것은 너무나 중요하다. 그것은 이주노동자들 스스로가 너무나 잘 알고 있다. 저임금과 장시간 노동, 자본가들의 폭력과 탄압 속에서도 이주노동자들은 직장을 옮길 자유가 없어 노예와도 같이 얽매여 있지 않은가. 이주노동자들은 1년 넘게 명동 농성투쟁을 하면서 고용허가제를 반대해 왔다. 고용허가제에는 사업장 이동의 자유가 없기 때문이다. 사업장 이동의 자유가 “완전하게” 적용되지 않는다면 아무리 법안의 다른 부분에서 노동기본권을 명시하더라도 그것은 제한적으로 되고 만다. “완전한” 사업장 이동의 자유를 보장하지 않는 노동허가제가 고용허가제와 다른 것이 과연 무엇일까?
The bill says that guarantees the basic labor rights and social security system to migrant workers. That is right. However, the bill limits the right MW to change their work places. Under the bill, MW can get work permit in specific types of industry. For example, if one MW get work permit on metal industry, he/she must work in metal industry. He/she can't work in other type of industry, like construction. If MW wants change his/her work place, he/she can change into the same type of insdustry and registered work place. And the chance is given to workers that worked 1 year at least. If MW violate this rules, MW will get a penalty - a fine not exceeding as many as 5,000,000 won. Too many limits! This is not the whole freedom to choose work place! For migrant workers, the freedom to choose work place is very very important. Last year, we had sit-in struggle in Myeong-dong for about 400 days. We said that we oppose EPS. Because EPS has no freedom to choose work place. Limited freedom to choose work place makes the basic labor rights to be useless. Is there any difference between EPS and WPS?
또, 입법안은 이주노동자의 체류기간을 일반노동허가 3년으로 규정하고 있다. 그리고 1년씩 두 번까지 연장하도록 되어 있다. 그렇게 5년이 지난 후엔 특별노동허가 5년을 부여하도록 되어 있다. 그러나 앞서 말했듯이 이주노동자는 자신이 원하는 기간만큼 자유롭게 일할 수 있어야 한다. 이미 10년이 넘도록 한국에서 일해 온 이주노동자들도 많이 있다. 체류기간을 법으로 정해놓는다는 것은 결국 또다시 미등록 이주노동자를 발생시킨다는 것을 의미한다. 게다가 입법안은 노동허가를 연장할 때 노동부 장관이 결정을 내리도록 하고 있다. 그런데 노동부 장관은 노동자를 위한 장관이 아니라 사실상 ‘자본부’ 장관이다. 자본가들 마음대로 이주노동자의 노동기간을 좌우하도록 하는 것이 과연 옳은 것인가?
Next, the bill limits the length of stay. 3year +1 +1. But, in Korea, many MW that has stayed over 10 years is living now. Limited length of stay surely will make unregistered MW again. And for extension of stay, MW must get permit from the Ministry of Labor. However, we cannot trust government. In Korea, the Ministry of Labor is not for workers, just for capitalist. In Korea, the Ministry of Labor take the lead of suppression on the labor. Will we have to obey?
이렇게 민주노동당 노동허가제 법안은 사업장 이동의 자유를 제한하고 있으며, 체류기간도 제한하고 있다. 이주노동자에게 가해지는 이런저런 제한들은 결국 이주노동자들의 노동권을 제한하는 역할을 하게 될 것이다. 따라서 이주노동자들은 입법안의 한계들을 결코 받아들여서는 안 된다.
KDLP's WPS bill has limits. Limit on the freedom to choose work place. Limit on the length of stay. Eventually, the basic labor rights will be limited. So MW must not leave these limits of the bill.
어떻게 싸워나가야 하는가
How can we fight?
한국 정부는 이주노조를 인정하지 않고 있다. 한국 정부는 평등노조 이주지부, 이주노동조합의 대표자들을 계속 연행해 갔다. 철저하게 이주노동자들의 단결을 탄압하고 있다. 이것은 자본가들이 이주노동자들의 투쟁을 두려워하기 때문이다. 많은 이주노동자들이 이주노동조합을 주목하고 있으며, 조합원이 꾸준히 늘어나고 있다. 각 지역에서 지부와 분회가 건설되고 있다. 함께 투쟁하는 동지들이 많아질수록, 투쟁의 힘은 더욱 커진다. 자본과 국가에게 통제받지 않는 이주노동자들의 자유로운 노동권과 노동자로서의 기본권 쟁취를 위해 우리는 어떻게 싸워야 할 것인가?
Korean government made MTU illegal. Korean government has arrested leaders of migrant workers' organization - ETU-MB, MSSC, MTU, etc. Why do Korean government oppress the struggling migrant workers? That's because Korean government and capitalist are afraid of our struggle. Many MW want to be a member of MTU. The member of MTU is increasing now. In each region, we are organizing branches and local groups. The more MW join our struggle, the more our struggle power will be up! Now, let's think about this. How can we fight?
노동자들의 힘은 단결에서 나온다. 노동조합으로 모인 모든 노동자들이 함께 싸워야만 그 힘은 현실이 된다. 노동조합 간부들, 대의원들만 투쟁하는 것이 아니라 전체 조합원이 함께 투쟁해야 한다. 소수의 간부들만 투쟁한다면, 한국 정부는 이주노조를 더욱 쉽게 탄압할 것이다. 간부들만 단속하면 이주노조는 무너질 것이기 때문이다. 그러나, 모든 조합원들이 똘똘 뭉쳐 투쟁한다면 결과는 달라진다. 자본가들에게 맞서는 투쟁의 힘은 더욱 강해지고, 이주노조 역시 더욱 단단해진다. 조합원들이 투쟁을 통해 단련되어 있다면, 노조탄압이 아무리 거세어도 우리는 노조를 사수할 수 있다.
"Let's fight together!" This slogan is very important. All the members of union must join the struggle. In that case, our unity becomes real power. The leader of MTU or MTU staffs or MTU representatives' struggle is important. Moreover, all union member must fight together. If only a small number of MTU staffs get into the struggle, Korean government suppress the struggle more easily. But if all the union members get into the struggle, the result will be change. MTU will be strong. And then, although heavy suppression of the capitalist, we can defend MTU - the core of migrant workers unity.
따라서 이주노동자들의 노동권을 쟁취하기 위한 투쟁은 국회 앞에서 국회를 압박하는 형태의 투쟁으로는 부족하다. 오히려 지역에 흩어져 있는 이주노동자 대중들이 “스스로” 투쟁하는 것이 더욱 중요하다. 때문에 각 지역에서의 강력한 집회를 통해 이주노동자들을 뭉치게 해야 한다. 또한, 이주노동자들이 노동하는 현장에서도 투쟁을 해야 한다. 체불임금, 산업재해, 해고, 저임금, 장시간노동으로 이주노동자들은 많은 고통을 받고 있지 않은가? 현장에서 자본가들과의 투쟁을 거치면서 이주노동자들은 투쟁을 더욱 확대시켜 나갈 수 있을 것이다. 이러한 투쟁들이 이주노동자의 노동권을 실제로 쟁취해 나가는 과정이 될 것이다. 이주노동자의 노동권을 법으로 제도화시키는 것은 이주노동자들의 투쟁력이 있을 때만이 가능하다는 사실을 기억해야 한다.
For achieve labor rights, taking struggle in front of the National Assembly for pass WPS bill has limits. In each region, taking an effort popular MW to join the struggle is more important. We must have rallies in each region. We also must have struggle in the factory. Because of wage unpaid, industrial disaster, dismissal, low wages, many long hours work, etc., many migrant worker are suffering now! If we don't fight directly in the factory by ourselves, the WPS law will be not guarantee any labor rights. The most important thing is workers' DIRECT ACTION IN FACTORY, IN RALLY!
동지 여러분! 올바른 투쟁 목표를 세우고 단결하여 투쟁하는 것만이 우리의 승리를 가져다 줄 것임을 잊지 말자! 자본가들의 억압과 탄압을 박살내고 이주노동자들의 노동권을 쟁취하기 위한 투쟁을 힘차게 벌여나가자. 그리고 전 세계 노동자들의 해방을 향해 투쟁해 나가자! 우리 역시 동지들과 힘차게 연대 투쟁해 나갈 것이다! 투쟁!
Comrades! We must have ultimate goals! And We must unite and struggle together! Then We will win! Let's fight together for liberation of migrant workers in Korea! Let's fight together for liberation of all workers in all countries! Korean students will join the struggle with solidarity! 투쟁!
